On December 30, 2021, the Government issued Decree 126/2021/ND-CP amending and supplementing some articles of the Decrees on sanctioning of administrative violations, including the field of standards, measurement measure, and quality products and goods.
According to Decree 126/2021, the fine level for the act of trading in goods is required to have goods labels but no goods labels; without the original label or with the original label but with insufficient or incorrect information on the required information on the goods label, or changed (previously defined as "no original label or original label but changed" ) as follows:
– A fine of from 01 to 03 million VND for infringing goods valued at less than 05 million VND.
(Previously, the infringing goods were valued at up to VND 05 million).
– A fine of between VND 03 – 05 million for infringing goods with a value of between VND 05 – under 10 million.
(Previously, the fine was from 03 – 06 million VND for infringing goods with a value of over 5 – 10 million VND)
– A fine of between VND 5 – 10 million for infringing goods valued at VND 10 – under 20 million.
(Previously, a fine of from 06 – 10 million VND for infringing goods with a value of over 10 – 20 million VND).
– A fine of from 10 to 15 million VND for infringing goods valued between 20 and under 30 million VND.
(Previously, this fine was applied to infringing goods with a value of over 20 – 30 million VND).
– A fine of between VND 15-25 million in case the infringing goods are valued between VND 30 and under 50 million;
(Previously, this fine was applied to infringing goods valued at over VND 30-50 million)…
In addition, Decree 126/2021 also adds regulations on fines 2 times higher than the above-mentioned fines in case of infringing goods are: food, food, food additives, processing aids foods, food preservatives, functional foods.
This Decree takes effect from January 1, 2022.
