The Ministry of Finance issued Circular No. 01/2022/TT-BTC dated 11/1/2022 stipulating the rate of collection, the regime of collection, payment, management, and use of fees for exploitation and use of water sources implemented by the central authority.
Circular No. 01/2022/TT-BTC of the Ministry of Finance stipulating the rate of collection, mode of collection, payment, management, and use of fees for exploitation and use of water sources, which are appraised by central agencies, include the appraisal of projects, reports on exploration and assessment of reserves, exploitation and use of underground water; Fees for assessment of dossiers and conditions for underground water drilling practice; Fees for appraisal of schemes on exploitation and use of surface water and seawater.
Accordingly, fees for appraisal of underground water exploration projects are regulated from exploration projects with water flow from 3,000 m3/day to 30,000 m3/day with rates ranging from 7.6 million VND/record and 16.4 million VND/record, depending on the amount of water flow.
Fees for appraisal of reports on results of exploration and assessment of underground water reserves with water flow from 3,000 m3/day to over 30,000 m3/day the rate of collection is from 9.4 million to 17 million dong/record depending on the water flow.
Fees for appraisal of reports on the current status of underground water exploitation with water flow from 3,000 m3/day to less than 10,000 m3/day, the rate of collection is 8 million VND; The highest fee is the appraisal fee for reporting the current status of underground water exploitation with a water flow of over 30,000 m3/day, the fee is 18.4 million VND.
Fees for appraisal of dossiers and conditions for large-scale underground water drilling practice are VND 3 million; Fees for appraisal of projects on exploitation and use of surface water and fees for appraisal of projects on exploitation and use of seawater are set from 12.8 million to 28.8 million VND.
Fees for appraisal of reports on the current status of underground water exploitation with water flow from 3,000 m3/day to less than 10,000 m3/day, the rate of collection is 8 million VND; The highest fee is the appraisal fee for reporting the current status of underground water exploitation with a water flow of over 30,000 m3/day, the fee is 18.4 million VND.
Fees for appraisal of dossiers and conditions for large-scale underground water drilling practice are VND 3 million; Fees for appraisal of projects on exploitation and use of surface water and fees for appraisal of projects on exploitation and use of seawater are set from 12.8 million to 28.8 million VND.
Fees for appraisal of projects and reports, in case of a request for an extension, adjustment of contents, or re-issuance due to transfer of permits for exploitation and use of underground water and surface water, shall be charged at 50% of the above-mentioned fee. . Fees for appraisal of projects and reports in case of a request for extension or modification of underground water exploration permits; Appraisal of dossiers and conditions in case of extension or adjustment of underground water drilling practice license, the fee is 30% of the above fee.
Circular No. 01/2022/TT-BTC clearly states that, by the 5th of every month, the toll collection organization must deposit the collected fee amount of the previous month into the fee account awaiting payment to the state budget opened at the State Treasury. The fee-collecting organization shall declare and pay the collected fee amount monthly, and settle the annual settlement.
The fee-collecting organization must remit 100% of the collected fee into the state budget. The source of expenses for the appraisal and collection of fees shall be arranged by the state budget in the estimate of the collecting organization according to the regime and norms of state budget expenditure following the provisions of law. In case the fee-collecting organization is entitled to set operating expenses from the deducted toll source, they will leave 50% of the total amount of the collected appraisal fee to spend on appraisal and fee collection activities and remit 50% to the house budget country.
Circular No. 01/2022/TT-BTC takes effect from February 25, 2022, replacing Circular No. 270/2016/TT-BTC dated November 14, 2016, of the Minister of Finance regulating the rate of collection, the mode of collection, payment, management, and use of fees for appraisal and granting of permits for exploration, exploitation, and use of water resources; discharge of wastewater into water sources and the practice of underground water drilling is carried out by the central authority.
