The Ministry of Finance has just issued Circular No. 02/2022/TT-BTC stipulating the collection rate, mode of collection, payment, management, and use of fees for assessment and grant of environmental permits by central authorities. Accordingly, the appraisal fee for the grant of an environmental permit ranges from 45 to 50 million VND/permit.
Circular No. 02/2022/TT-BTC clearly states that organizations and individuals request central competent state agencies to carry out the grant appraisal, re-issuance, or adjustment of environmental permits is the payer of the fee as prescribed.
Specifically, for projects or establishments belonging to group 1 (except for some projects), there is a fee for the appraisal, the re-issuance of environmental permits is VND 50 million/permit. Meanwhile, for projects or establishments belonging to group II, or projects or establishments located in the area of 2 or more provincial-level administrative units or located in the border areas where the administrative management responsibility of the provincial People's Committee has not yet been determined, the fee is 45 million VND/permit.
The appraisal fee for environmental permit adjustment is 15 million VND/permit/project/facility.
It should be noted that the above fee is calculated according to the time of appraisal, re-issuance, and adjustment of environmental permits. The fee does not include the travel costs of the actual inspection team at the facility and the cost of sampling and analyzing waste samples as prescribed.
The fee payer shall pay the assessment fee within 10 working days from the date of submitting the application for the grant, re-grant, or adjustment of the environmental permit.
The Ministry of Natural Resources and Environment, the Ministry of Public Security, the Ministry of National Defense, or the state agencies under the 3 Ministries are assigned to carry out the assessment, re-issuance, and adjustment of environmental permits as prescribed by law is the fee-collecting organization specified in this Circular.
The fee-collecting organization shall remit the entire collected fee amount to the state budget. The source of expenses for the appraisal and collection of fees shall be arranged by the state budget in the estimate of the toll collection organization according to the regimes and norms of state budget expenditures as prescribed.
In case the fee-collecting organization is a state agency, it is entitled to contract its operating expenses from the toll collection following the Government's Decree No. 120/2016/ND-CP to deduct 90% of the collected fee to cover expenses for the contents of expenditure as prescribed; pay 10% of the collected fee amount into the state budget.
Circular No. 02/2022/TT-BTC comes into force from January 11, 2022.
