The Vietnam General Confederation of Labor (VGCL) has issued Decision 3308/QD-TLD promulgating the Regulations on principles of building and assigning trade union financial estimates for 2022.
Specifically:
About collecting union dues
– Employees who are required to pay trade union dues
+ For agencies, organizations, and businesses that have established grassroots trade unions:
Provincial and municipal Labor Confederation; Central industry trade union and equivalent; Trade Union Corporation under the General Confederation: Statistics on the number of employees subject to the payment of trade union fees according to regulations include:
Employees are paying social insurance (social insurance) as of June 30, 2021 (should take data close to the time of making the 2022 estimate);
Employees at the units subject to payment of CPC but not yet participating in social insurance;
Labor is expected to increase (decrease) at the unit in the 2022 plan year.
+ For businesses that have not yet established a grassroots trade union:
The list of enterprises that have paid social insurance premiums as of June 30, 2021, must be made statistics, then determine the number of employees at enterprises such as agencies, organizations, and enterprises that have established grassroots trade unions.
In 2022, the plan to collect 2% of the CPC has not been assigned to enterprises that have not yet established a grassroots trade union with less than 10 employees, but still encourage the collection units.
– About the salary fund to collect union dues
The salary fund to determine the collection of trade union fees in 2022 at the units is determined as follows:
The average salary for social insurance contributions for employees in the first 06 months of 2021 x the number of employees subject to paying trade union fees.
About the collection of union fees
– The amount of trade union dues collected in 2022 is determined based on the actual number of trade unionists at grassroots trade unions x wages and allowances of the union members.
– The average collection of trade union dues of 01 union member in 2022 is guaranteed not to be lower than the average collection rate of 01 trade union member according to the approved 2020 settlement report.
In the case of localities affected by the Covid-19 epidemic, it is necessary to have a separate explanation for the decrease in union dues collection compared to the final settlement in 2020.
