The Government promulgates Decree 126/2021/ND-CP amending and supplementing some articles of the decrees providing for the sanctioning of administrative violations in the field of industrial property; standards, measurement and product, and goods quality; science and technology activities, technology transfer; nuclear energy.
In particular, Decree 126/2021/ND-CP amending and supplementing some articles of the Government's Decree No. 119/2017/ND-CP dated November 1, 2017, stipulating penalties for administrative violations in the field of administrative violations. areas of standards, measurement, and product and goods quality.
Decree No. 126/2021/ND-CP amending Article 29 violates regulations in gasoline mixing. Specifically, a fine of 40-60 million dong for one of the following acts:
+ Mixing gasoline but not registering the dispensing establishment.
+ Prepare gasoline without a certificate from a competent authority.
+ Using the expired registration certificate of gasoline dispensing establishment.
+ Using uncommon additives and preparations to mix gasoline without the consent of the competent authority.
+ Prepare gasoline at a location other than the place of production or dispensing workshop as stated in the registration certificate of gasoline dispensing establishment.
Fine of up to 60 million VND for violations of regulations in gas production and preparation
Decree 126/2021/ND-CP also adds Article 29a, which violates regulations on gas production and preparation after Article 29. Specifically, a fine of between VND 10-20 million will be imposed for one of the following acts: Performed gas preparation but failed to submit the Self-Declaration of conformity with the gas preparation conditions as prescribed; did not notify the competent authority of the standard of the additive used to prepare the gas as prescribed.
A fine of between VND 40-60 million shall be imposed for one of the following acts:
+ Having no gas quality testing laboratory or having a minimum 1-year lease contract with a trader or organization having a testing laboratory that has registered testing activities following the law and is fully capable of testing the following indicators gas quality standards according to published applied standards and national technical regulations.
+ Prepare gas at a location other than those stated in the self-declaration of conformity to gas preparation conditions sent to the competent management agency.
Decree 126/2021/ND-CP comes into effect from January 1, 2022.
