This is the content of Circular 19/2021/TT-BLDTBXH promulgating a list of extremely difficult areas as a basis for determining the cases where it is possible to retire at an age lower than the retirement age under normal working conditions.
Accordingly, promulgating a list of regions with extremely difficult socio-economic conditions as a basis for determining the cases where it is possible to retire at a lower age according to the provisions of Clause 3, Article 169 of the Labor Code and Article 5 of Decree 135/2020/ND-CP on the retirement age.
This list includes 27 provinces, cities, 01 production, and other administrative units with extremely difficult socio-economic conditions, for example:
– Bac Kan: 05 districts with 21 communes;
– Binh Phuoc: 02 districts with 04 communes;
– Binh Thuan: 1 district with 1 commune;
– Cao Bang: 07 districts with 59 communes;

Cases where retirement can be made at a lower age as prescribed in Clause 3, Article 169 of the Labor Code:
Article 169. Age of retirement
3. Employees have their working capacity reduced; doing particularly heavy, hazardous, and dangerous occupations and jobs; doing heavy, hazardous, or dangerous occupations or jobs; working in areas with extremely difficult socio-economic conditions may retire at a lower age but not exceeding 05 years of age as prescribed in Clause 2 of this Article at the time of retirement unless otherwise required by law another rule.
Circular 19/2021/TT-BLDTBXH comes into effect from January 30, 2022, and will be applied from January 1, 2021.
