(BKTO) - Sắp tới, Chính phủ sẽ ban hành Nghị quyết tiếp tục cắt giảm tiếp 56 ngành, nghề và điều chỉnh phạm vi của 14 ngành, nghề đầu tư kinh doanh có điều kiện. Trước đó, Luật Đầu tư số 143/2025/QH15 đã cắt giảm 39 ngành, nghề đầu tư kinh doanh có điều kiện không còn phù hợp, đồng thời sửa đổi phạm vi của 20 ngành, nghề đầu tư kinh doanh có điều kiện khác.

Đây là thông tin được bà Hoàng Thị Nam Phương - Phó Trưởng phòng Pháp chế, Tài chính ngân sách, Vụ Pháp chế (Bộ Tài chính) chia sẻ khi giới thiệu những điểm mới quan trọng của Luật Đầu tư số 143/2025/QH15 và Nghị định số 96/2026/NĐ-CP, trong khuôn khổ Hội nghị tập huấn, tuyên truyền pháp luật của Kiểm toán nhà nước, diễn ra chiều 11/6.

Bà Hoàng Thị Nam Phương cho biết, Luật Đầu tư số 143/2025/QH15 được Quốc hội thông qua ngày 11/12/2025, thay thế Luật Đầu tư năm 2020. Luật gồm 7 chương, 52 điều và 4 phụ lục, điều chỉnh toàn diện hoạt động đầu tư kinh doanh tại Việt Nam cũng như hoạt động đầu tư từ Việt Nam ra nước ngoài.

Một trong những điểm mới đáng chú ý của Luật là việc tiếp tục mở rộng quyền tự do kinh doanh của nhà đầu tư thông qua rà soát, cắt giảm các ngành, nghề đầu tư kinh doanh có điều kiện.

Theo đó, Luật đã cắt giảm 39 ngành, nghề đầu tư kinh doanh có điều kiện không còn phù hợp, đồng thời sửa đổi phạm vi của 20 ngành, nghề đầu tư kinh doanh có điều kiện khác.

Đối với ngành, nghề cấm đầu tư kinh doanh, Luật bổ sung quy định cấm kinh doanh thuốc lá điện tử, thuốc lá nung nóng nhằm bảo đảm thực hiện chủ trương bảo vệ sức khỏe cộng đồng theo Nghị quyết số 173/2024/QH15 của Quốc hội.

Về chính sách ưu đãi, hỗ trợ đầu tư, bà Hoàng Thị Nam Phương nêu rõ, Luật tập trung khuyến khích các lĩnh vực có tính chiến lược như khoa học, công nghệ, đổi mới sáng tạo, chuyển đổi số, công nghiệp bán dẫn, kinh tế xanh, kinh tế tuần hoàn, năng lượng tái tạo, công nghiệp hỗ trợ, công nghiệp dược, phát triển hạ tầng và các lĩnh vực giáo dục, y tế, văn hóa.

Đồng thời, quy định mới cũng làm rõ hơn các địa bàn được hưởng ưu đãi đầu tư theo đơn vị hành chính cấp xã sau sắp xếp. Ủy ban nhân dân cấp tỉnh xác định và công bố địa bàn ưu đãi đầu tư cấp xã.

Đáng chú ý, Luật Đầu tư 2025 tiếp tục đẩy mạnh phân cấp, phân quyền trong công tác quản lý đầu tư. Nhiều dự án trước đây thuộc thẩm quyền chấp thuận chủ trương đầu tư của Quốc hội được phân cấp cho Thủ tướng Chính phủ xem xét, quyết định, ngoại trừ các dự án có yêu cầu áp dụng cơ chế, chính sách đặc biệt.

Bên cạnh đó, thẩm quyền chấp thuận chủ trương đầu tư ở địa phương được giao cho Chủ tịch UBND cấp tỉnh thay vì UBND cấp tỉnh như trước đây, góp phần đơn giản hóa quy trình, rút ngắn thời gian xử lý hồ sơ. Luật cũng thu hẹp phạm vi các dự án phải thực hiện thủ tục chấp thuận chủ trương đầu tư, đồng thời đơn giản hóa nội dung thẩm định dự án. 

"Theo Luật Đầu tư năm 2025, thời gian giải quyết thủ tục chấp thuận chủ trương đầu tư được rút ngắn còn 25 ngày đối với dự án thuộc thẩm quyền của Thủ tướng Chính phủ và 17 ngày đối với dự án thuộc thẩm quyền của Chủ tịch UBND cấp tỉnh."

Một điểm mới nổi bật khác là Luật Đầu tư 2025 đã thiết lập cơ chế thủ tục đầu tư đặc biệt  (cơ chế luồng xanh). Theo đó, tất cả các dự án đầu tư trong khu công nghiệp, khu chế xuất, khu công nghệ cao, khu công nghệ số tập trung, khu thương mại tự do, trung tâm tài chính quốc tế và các khu chức năng trong khu kinh tế đều có thể lựa chọn thực hiện theo thủ tục đầu tư đặc biệt, thay vì chỉ giới hạn ở một số lĩnh vực công nghệ cao, trung tâm đổi mới sáng tạo như trước đây.

Ngoài ra, Luật bổ sung nhiều quy định nhằm tháo gỡ khó khăn trong quá trình triển khai dự án như giảm các trường hợp phải điều chỉnh chủ trương đầu tư, đơn giản hóa thủ tục ký quỹ bảo đảm thực hiện dự án, bổ sung các trường hợp không tính vào tiến độ thực hiện dự án, làm rõ quy định về chuyển nhượng dự án bất động sản và tạo thuận lợi hơn cho nhà đầu tư nước ngoài trong việc thành lập tổ chức kinh tế tại Việt Nam.

Ngoài ra, Luật sửa đổi, bổ sung quy định về việc tiếp nhận và giải quyết thủ tục  hành chính về đầu tư, chấm dứt hoạt động của dự án đầu tư… để tháo gỡ khó khăn, vướng mắc trong thời gian qua.

Với nhiều nội dung có tính đột phá, những sửa đổi, bổ sung của Luật Đầu tư năm 2025 và Nghị định số 96/2026/NĐ-CP hướng tới mục tiêu cải thiện mạnh mẽ môi trường đầu tư kinh doanh, giảm chi phí tuân thủ, nâng cao tính minh bạch, đồng thời tạo động lực thu hút các dòng vốn đầu tư chất lượng cao, góp phần thúc đẩy tăng trưởng kinh tế trong giai đoạn mới.
