Công văn 2926/CT-CS ngày 11/5/2026 của Cục Thuế đã hướng dẫn việc áp dụng ưu đãi thuế thu nhập doanh nghiệp (TNDN) đối với hoạt động chăn nuôi theo quy định tại Nghị định 320/2025/NĐ-CP, áp dụng từ kỳ tính thuế năm 2025.

Theo Công văn 2926/CT-CS, mức ưu đãi thuế được xác định dựa trên địa bàn thực hiện hoạt động chăn nuôi và loại thu nhập thực tế phát sinh của doanh nghiệp.

Căn cứ điểm a khoản 1 Điều 4 Nghị định 320/2025/NĐ-CP, thu nhập của doanh nghiệp từ hoạt động chăn nuôi tại địa bàn có điều kiện kinh tế - xã hội đặc biệt khó khăn được miễn thuế TNDN.

Khoản thu nhập được miễn thuế gồm thu nhập từ sản phẩm do doanh nghiệp tự chăn nuôi, thu nhập từ thanh lý vật nuôi, bán phế liệu, phế phẩm liên quan đến hoạt động chăn nuôi và thu nhập từ sản phẩm chăn nuôi sau sơ chế thông thường.

Ngoài chính sách miễn thuế nêu trên, hoạt động chăn nuôi còn thuộc ngành, nghề ưu đãi thuế TNDN theo điểm 1 khoản 2 Điều 18 Nghị định 320/2025/NĐ-CP. Đáng chú ý, Điều 19 Nghị định này quy định rõ mức thuế suất ưu đãi theo từng địa bàn hoạt động.

Cụ thể, doanh nghiệp thực hiện hoạt động chăn nuôi tại địa bàn có điều kiện kinh tế - xã hội khó khăn được áp dụng thuế suất TNDN 10% trong suốt thời gian hoạt động. Trong khi đó, doanh nghiệp chăn nuôi hoạt động tại địa bàn không thuộc địa bàn ưu đãi vẫn được áp dụng thuế suất ưu đãi 15% trong suốt thời gian hoạt động.

Về địa bàn được hưởng ưu đãi, khoản 3 Điều 18 Nghị định 320/2025/NĐ-CP xác định gồm địa bàn có điều kiện kinh tế - xã hội đặc biệt khó khăn và địa bàn có điều kiện kinh tế - xã hội khó khăn theo Danh mục địa bàn ưu đãi đầu tư tại Phụ lục III ban hành kèm Nghị định 31/2021/NĐ-CP, đã được sửa đổi, bổ sung bởi Nghị định 239/2025/NĐ-CP.

Tại Công văn 2926/CT-CS, Cục Thuế lưu ý doanh nghiệp phải căn cứ đồng thời vào ngành nghề hoạt động, địa bàn thực hiện hoạt động chăn nuôi và tình hình thực tế phát sinh thu nhập để xác định đúng trường hợp được miễn thuế hoặc áp dụng mức thuế suất ưu đãi theo quy định từ kỳ tính thuế năm 2025.
