Ngày 05/05/2026, Chính phủ đã ban hành Nghị định 144/2026/NĐ-CP sửa đổi, bổ sung một số điều của Nghị định 181/2025/NĐ-CP về thi hành Luật Thuế giá trị gia tăng, có hiệu lực từ ngày 20/06/2026.

Nghị định này điều chỉnh các quy định liên quan đến thuế giá trị gia tăng (GTGT) đối với các dịch vụ bảo hiểm và sản phẩm xuất khẩu là tài nguyên, khoáng sản. Đối tượng áp dụng bao gồm các tổ chức, cá nhân kinh doanh trong các lĩnh vực này.

- Bổ sung dịch vụ bảo hiểm vào danh mục không chịu thuế GTGT

Nghị định bổ sung các dịch vụ bảo hiểm như bảo hiểm nhân thọ, bảo hiểm sức khỏe, bảo hiểm nông nghiệp và bảo hiểm tàu thuyền vào danh mục các dịch vụ không chịu thuế GTGT. Điều này nhằm hỗ trợ và khuyến khích các hoạt động bảo hiểm trong các lĩnh vực quan trọng.

- Quy định về bán nợ và chứng chỉ tiền gửi

Bán nợ, bao gồm cả bán khoản phải trả và khoản phải thu, cũng như bán chứng chỉ tiền gửi, được quy định rõ ràng hơn trong nghị định này. Điều này giúp làm rõ các hoạt động tài chính liên quan và đảm bảo tính minh bạch trong việc áp dụng thuế GTGT.

- Hạn chế xuất khẩu tài nguyên, khoáng sản thô

Nghị định quy định rõ ràng về việc hạn chế xuất khẩu các tài nguyên, khoáng sản thô chưa qua chế biến. Danh mục các sản phẩm này được liệt kê chi tiết trong Phụ lục I và II kèm theo nghị định. Bộ Công Thương có trách nhiệm đề xuất điều chỉnh danh mục này khi cần thiết để phù hợp với định hướng kinh tế - xã hội của nhà nước.

- Điều chỉnh doanh thu không chịu thuế GTGT

Doanh thu từ hoạt động đại lý bán hàng hóa, dịch vụ và hoa hồng môi giới dịch vụ bảo hiểm thuộc đối tượng không chịu thuế GTGT. Quy định này giúp làm rõ hơn các trường hợp không phải nộp thuế GTGT, tạo điều kiện thuận lợi cho các doanh nghiệp hoạt động trong lĩnh vực này.

- Khấu trừ thuế GTGT đầu vào cho hàng hóa trả chậm

Nghị định cho phép khấu trừ thuế GTGT đầu vào đối với hàng hóa, dịch vụ mua trả chậm, trả góp có giá trị từ 5 triệu đồng trở lên, ngay cả khi chưa có chứng từ thanh toán không dùng tiền mặt. Tuy nhiên, nếu đến thời điểm thanh toán mà không có chứng từ này, doanh nghiệp phải điều chỉnh giảm số thuế GTGT đầu vào đã khấu trừ.
