Kiểm toán nhà nước (KTNN) vừa ban hành văn bản số 1047/KTNN-TT ngày 07/7/2026 về Tăng cường thi hành pháp luật về xử lý vi phạm hành chính trong lĩnh vực kiểm toán nhà nước.

Văn bản được ban hành nhằm tăng cường hiệu lực, hiệu quả công tác thi hành pháp luật về xử lý vi phạm hành chính trong lĩnh vực kiểm toán nhà nước; bảo đảm việc phát hiện, xử lý vi phạm hành chính được thực hiện nghiêm minh, khách quan, đúng pháp luật; nâng cao trách nhiệm của người có thẩm quyền xử lý vi phạm hành chính trong lĩnh vực kiểm toán nhà nước và thực hiện đầy đủ trách nhiệm của KTNN theo quy định tại Điều 17, Điều 18 Luật Xử lý vi phạm hành chính năm 2012 (được sửa đổi, bổ sung năm 2020, năm 2025), Pháp lệnh số 04/2023/UBTVQH15 ngày 28/02/2023 của Ủy ban Thường vụ Quốc hội về Xử phạt vi phạm hành chính trong lĩnh vực kiểm toán nhà nước (Pháp lệnh số 04/2023/UBTVQH15).

Theo đó, Tổng Kiểm toán nhà nước yêu cầu các đơn vị trực thuộc KTNN nâng cao trách nhiệm của người có thẩm quyền xử lý vi phạm hành chính trong lĩnh kiểm toán nhà nước.

Cụ thể, Kiểm toán trưởng các KTNN chuyên ngành, khu vực, Trưởng đoàn kiểm toán, thành viên Đoàn kiểm toán và các cá nhân được giao nhiệm vụ theo quy định có trách nhiệm chủ động phát hiện, xác minh, lập hồ sơ và xử lý kịp thời các hành vi vi phạm hành chính trong lĩnh vực kiểm toán nhà nước theo đúng quy định của pháp luật; bảo đảm việc xử lý được thực hiện đúng thẩm quyền, đúng đối tượng, đúng trình tự, thủ tục, khách quan, công khai, minh bạch.

Khi xem xét xử lý vi phạm hành chính trong lĩnh vực kiểm toán nhà nước phải xác định đầy đủ hành vi vi phạm, chủ thể vi phạm, yếu tố lỗi, trách nhiệm của tổ chức, cá nhân có liên quan và trách nhiệm của người đứng đầu cơ quan, đơn vị.

Đặc biệt, nghiêm cấm hành vi né tránh, chậm trễ, không xem xét xử lý hoặc cố ý bỏ lọt hành vi vi phạm hành chính đã được phát hiện và có đủ căn cứ xử lý theo quy định.

Trường hợp người có thẩm quyền lập biên bản, người có thẩm quyền xử phạt không thực hiện hoặc thực hiện không đầy đủ trách nhiệm được giao, dẫn đến bỏ lọt hành vi vi phạm hoặc làm ảnh hưởng đến hiệu lực, hiệu quả thi hành pháp luật về xử lý vi phạm hành chính trong lĩnh vực kiểm toán nhà nước thì phải xem xét trách nhiệm theo quy định của pháp luật về cán bộ, công chức và các quy định của KTNN.

Tổng Kiểm toán nhà nước cũng yêu cầu các đơn vị trực thuộc tăng cường công tác kiểm tra, tự kiểm tra việc thi hành pháp luật về xử lý vi phạm hành chính trong lĩnh vực kiểm toán nhà nước.

Theo đó, Kiểm toán trưởng các KTNN chuyên ngành và khu vực có trách nhiệm rà soát, đánh giá các trường hợp phát sinh dấu hiệu vi phạm hành chính trong lĩnh vực kiểm toán nhà nước nhưng chưa thực hiện việc lập biên bản hoặc xử lý theo quy định để xác định nguyên nhân, trách nhiệm và kịp thời chấn chỉnh.

Đồng thời chịu trách nhiệm trước Tổng Kiểm toán nhà nước về việc tổ chức thực hiện Pháp lệnh số 04/2023/UBTVQH15 và Quyết định số 811/QĐ-KTNN ngày 02/6/2023 của Tổng KTNN về Hướng dẫn thực hiện xử lý vi phạm hành chính trong lĩnh vực KTNN.

Kết quả thực hiện trách nhiệm phát hiện, xem xét, xử lý hoặc kiến nghị xử lý các hành vi vi phạm hành chính theo quy định của Pháp lệnh số 04/2023/UBTVQH15 được xem xét khi đánh giá chất lượng thực hiện nhiệm vụ kiểm toán của đơn vị, Đoàn kiểm toán và cá nhân có liên quan.
