Chuyển động theo các định hướng lớn của Đảng, Nhà nước, hiện nay, Đảng ủy, lãnh đạo Kiểm toán nhà nước (KTNN) đang chủ trương đẩy mạnh phân cấp, phân quyền trong hoạt động kiểm toán.

Chiều 27/7, Hội nghị thảo luận về quy định phân cấp trong hoạt động kiểm toán đã diễn ra tại trụ sở KTNN. Phó Tổng Kiểm toán nhà nước Trần Minh Khương chủ trì Hội nghị.

Tham dự Hội nghị, về phía khách mời có bà Nguyễn Thị Hạnh - Cục trưởng Cục Pháp luật hình sự - hành chính và Quản lý xử lý vi phạm hành chính (Bộ Tư pháp); bà Trần Thị Minh Châu - Phó Vụ trưởng Vụ Tổ chức - biên chế (Bộ Nội vụ) và đại diện của 2 Bộ.

Về phía KTNN còn có Vụ trưởng Vụ Tổng hợp Hoàng Văn Lương, Vụ trưởng Vụ Pháp chế Hoàng Phú Thọ và một số công chức của 2 Vụ…

Tại Hội nghị, Phó Tổng Kiểm toán nhà nước Trần Minh Khương nhấn mạnh một số cơ sở pháp lý đặt ra yêu cầu phải phân cấp, phân quyền, bao gồm: Nghị quyết Hội nghị Lần thứ 6 Ban chấp hành Trung ương khóa XII số 18-NQ/TW ngày 25/10/2017 về một số vấn đề về tiếp tục đổi mới, sắp xếp tổ chức bộ máy của hệ thống chính trị tinh gọn, hoạt động hiệu lực, hiệu quả; Kết luận số 226-KL/TW ngày 11/12/2025 của Ban Bí thư về việc chấn chỉnh lề lối làm việc, nâng cao hiệu quả hoạt động của hệ thống chính trị; Kết luận Số 121-KL/TW ngày 24/01/2025 của Ban Chấp hành Trung ương Đảng khóa XIII về tổng kết Nghị quyết số 18-NQ/TW, ngày 25/10/2017 của Ban Chấp hành Trung ương Đảng khóa XII một số vấn đề về tiếp tục đổi mới, sắp xếp tổ chức bộ máy của hệ thống chính trị tinh gọn, hoạt động hiệu lực, hiệu quả.

Đồng thời, Phó Tổng Kiểm toán nhà nước Trần Minh Khương dẫn ra Điều 8 của Luật Tổ chức Chính phủ số 63/2025/QH15 quy định phân cấp trong hệ thống cơ quan nhà nước là việc cơ quan, người có thẩm quyền giao cơ quan, tổ chức, đơn vị, cá nhân khác thực hiện liên tục, thường xuyên một hoặc một số nhiệm vụ, quyền hạn mà mình được giao theo quy định của pháp luật với các điều kiện bảo đảm thực hiện nhiệm vụ, quyền hạn đó theo nguyên tắc cơ quan, tổ chức, đơn vị, cá nhân được phân cấp chịu trách nhiệm hoàn toàn về kết quả thực hiện nhiệm vụ, quyền hạn được phân cấp. Việc phân cấp phải được quy định trong văn bản quy phạm pháp luật của cơ quan, người có thẩm quyền phân cấp. Bộ trưởng, Thủ trưởng cơ quan nganh Bộ phân cấp cho... đơn vị trực thuộc Bộ, cơ quan ngang Bộ, trừ trường hợp pháp luật quy định không được phân cấp. Cơ quan, người phân cấp có trách nhiệm bảo đảm các điều kiện cần thiết khi quyết định phân cấp...”.

Phó Tổng Kiểm toán nhà nước Trần Minh Khương cũng nêu rõ, Đảng ủy, Ban lãnh đạo KTNN chủ trương đẩy mạnh phân cấp, phân quyền trong hoạt động kiểm toán. Do đó, Phó Tổng Kiểm toán nhà nước đề nghị các đại biểu cần tập trung làm rõ: KTNN có được phân quyền trong hoạt động kiểm toán không, dựa vào nguyên tắc, quy định nào, phạm vi, giới hạn ra sao; nếu được phân cấp thì nên thực hiện như thế nào trong khâu xét duyệt kế hoạch kiểm toán, xét duyệt dự thảo báo cáo kiểm toán (BCKT); nếu không được phân cấp mà chỉ được ủy quyền thì thực hiện như thế nào?

Theo Vụ trưởng Vụ Tổng hợp Hoàng Văn Lương, thực tế qua các năm, công tác thẩm định dự thảo báo cáo kiểm toán của các Vụ tham mưu đã đi vào nề nếp, nhiệm vụ thẩm định được thực hiện hiệu quả. Kết quả thẩm định dự thảo báo cáo kiểm toán của các Vụ tham mưu là cơ sở để đơn vị chủ trì cuộc kiểm toán hoàn thiện báo cáo kiểm toán, tham mưu lãnh đạo Kiểm toán nhà nước xem xét, quyết định những nội dung trong báo cáo kiểm toán trước khi ký phát hành báo cáo kiểm toán.

Với chủ trương đẩy mạnh phâp cấp, lãnh đạo KTNN đã giao Vụ Tổng hợp tham mưu xây dựng Thông tư quy định trình tự lập, thẩm định, phê duyệt và phát hành báo cáo kiểm toán. Vì vậy, KTNN rất mong muốn đại diện Bộ Tư pháp, Bộ Nội vụ hướng dẫn việc tổ chức thực hiện phân cấp của Tổng Kiểm toán nhà nước cho các Kiểm toán trưởng KTNN chuyên ngành, khu vực lập, thẩm định và phát hành báo cáo kiểm toán để đảm bảo thực hiện đúng chủ trương của Đảng, pháp luật của Nhà nước.

Tại Hội nghị, các đại biểu đã tập trung làm rõ, trao đổi về căn cứ pháp lý để Tổng Kiểm toán nhà nước thực hiện phân cấp, ủy quyền trong hoạt động kiểm toán.

Kết luận Hội nghị, Phó Tổng Kiểm toán nhà nước Trần Minh Khương cảm ơn các ý kiến trao đổi của đại diện Bộ Nội vụ, Bộ Tư pháp; đồng thời giao nhiệm vụ cụ thể cho Vụ Tổng hợp trên cơ sở lắng nghe, tiếp thu ý kiến của các đại biểu tiếp tục nghiên cứu, đề xuất, hoàn thiện Dự thảo Thông tư báo cáo lãnh đạo KTNN xem xét, quyết định.

On the morning of September 25, at the headquarters of the State Audit Office of Vietnam (SAV), the SAV Steering Committee for the Development of Science, Technology, Innovation and Digital Transformation held its regular meeting under the chairmanship of Nguyen Huu Nghia, Member of the Party Central Committee, Secretary of the SAV Party Committee, State Auditor General and Head of the Steering Committee.
